REMITRIP – TERMS OF USE (FINAL LEGAL VERSION)

These Terms of Use (“Terms”) constitute a legally binding agreement between Remitrip Private Limited, a company incorporated under the laws of India and having its registered office at 3rd Floor, AMV Park, NH 47 Bypass, Kundannoor, Maradu – 682304, Kerala (“Remitrip”, “we”, “us”, “our”), and any user (“you”, “your”, “user”) accessing, downloading, installing, registering on, or using the Remitrip mobile application (“App”), the website www.remitrip.com (“Website”), or any feature or service provided through them (collectively, the “Services”).
By accessing or using the Services, you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree to these Terms, you must stop using the Services immediately.
These Terms must be read together with our Privacy Policy, Refund & Cancellation Policy, Payment Policy, and any guidelines or notices issued by Remitrip from time to time. Continued use of the Services constitutes acceptance of all revised Terms and policies.
1. ABOUT REMITRIP AND SERVICE SCOPE
Remitrip is a digital platform that enables users to search trains, check availability, book and cancel train tickets, track PNR status, receive journey updates, and place food orders through IRCTC’s authorised e-catering partners. All train-related services offered on the App are made possible through Remitrip’s authorised integration with Indian Railway Catering and Tourism Corporation Ltd. (IRCTC).
1.1 Remitrip as a Facilitator
Remitrip acts solely as a facilitator between users and IRCTC. We do not own, operate, control, or manage Indian Railways or IRCTC services. All bookings, cancellations, refunds, fares, seat availability, waiting list movements, and travel outcomes are governed strictly by:
- IRCTC terms and conditions
- Indian Railways Act and commercial circulars
- Government of India rules
Remitrip’s role is limited to providing a technological interface to assist users.
2. ELIGIBILITY AND ACCOUNT USAGE
To use the Services, you must be 18 years or older and legally competent to enter into a contract under Indian law. Users below 18 may use the Services only under the supervision of a parent or legal guardian.
A valid IRCTC User ID is mandatory for booking train tickets. Remitrip does not store IRCTC passwords; credentials are encrypted and securely transmitted to IRCTC servers for authentication.
You are responsible for ensuring that information provided is accurate and updated, maintaining confidentiality of your login credentials, and all activity occurring under your account or device. Remitrip is not liable for misuse of your account due to shared credentials, device compromise, or negligence.
3. IRCTC COMPLIANCE AND MANDATORY TERMS
By using Remitrip to book train tickets, you expressly agree to comply with all IRCTC rules, policies, and instructions, including:
- IRCTC ticketing terms and user policies
- Indian Railways commercial circulars
- Cancellation and refund rules
- Dynamic fare rules
- Identity and verification requirements
- Quota, Tatkal, Premium Tatkal, and concession guidelines
IRCTC may amend its rules at any time. Such amendments automatically apply to all Remitrip users.
4. SERVICES OFFERED
4.1 Train Search & Availability
The App allows users to search trains, schedules, seat classes, and availability based on data received from IRCTC.
4.2 Train Ticket Booking
All bookings are processed exclusively through IRCTC’s system using the user’s IRCTC ID. A booking is confirmed only when IRCTC issues a final confirmation.
4.3 Ticket Cancellation & Refund
All cancellations and refunds are calculated and governed entirely by IRCTC. Remitrip does not influence refund eligibility, charges, or timelines.
4.4 PNR Status & Journey Alerts
PNR updates, delay alerts, coach information, and journey notifications depend on IRCTC/Indian Railways data.
4.5 E-Catering Services
Food orders are executed solely by IRCTC-authorised catering partners. Remitrip only facilitates the booking.
4.6 Customer Support
Remitrip assists with app usage, payment issues, and user-side technical concerns. Railway operational issues, refunds, and booking decisions remain under IRCTC’s authority.
4.7 Future Services
Remitrip may introduce additional features, and such features will also be governed by these Terms unless otherwise stated.
5. PAYMENTS, FEES & CHARGES
5.1 Convenience and Platform Fees
Remitrip may charge convenience fees, platform fees, or service charges for bookings and ancillary features. Fees may vary by train type, class, demand, or service level. The fee is displayed before confirming the booking.
5.2 Taxes
GST or other applicable taxes will be collected as per Indian law.
5.3 Payment Failures
If payment is successful but booking fails, refunds are processed by IRCTC or the payment gateway as per their rules. Remitrip does not determine or expedite refund timelines.
5.4 Compliance with RBI Digital Payment Regulations
All payments made through the App comply with RBI’s guidelines for online transactions and payment intermediaries.
6. CANCELLATION & REFUND POLICY
All cancellations and refunds for train tickets are governed exclusively by IRCTC. Key IRCTC principles include:
- cancellation charges apply per IRCTC norms
- Tatkal and Premium Tatkal tickets are generally non-refundable
- no refund is issued for confirmed tickets not cancelled within IRCTC timelines
- refund processing typically takes 3–7 working days depending on the payment gateway/bank
- service fees charged by Remitrip may be non-refundable
Remitrip cannot override IRCTC rules.
7. USER CONDUCT AND PLATFORM RULES
You agree not to misuse or manipulate the platform, use bots or automation, impersonate another person, use fraudulent IRCTC IDs, attempt to hack or disrupt the App, post abusive or illegal content, or violate IRCTC rules. Violation may lead to suspension or permanent termination of Services.
8. PRIVACY AND DATA PROTECTION
Your use of the Services is governed by the Privacy Policy. By using Remitrip, you consent to the collection, use, processing, and storage of your data as described. IRCTC login credentials are never stored by Remitrip.
8.1 Data Retention
User data is retained only for IRCTC compliance, regulatory obligations, dispute resolution, and lawful business purposes.
9. COMMUNICATION CONSENT
By using the Services, you consent to receive SMS, email, WhatsApp, push notifications, and system alerts regarding bookings, cancellations, journey updates, security notifications, service messages, and promotional offers (opt-out available). Communications follow TRAI guidelines.
10. THIRD-PARTY SERVICES
Certain services depend on third parties, including payment gateways, IRCTC e-catering partners, and Indian Railways data providers. Remitrip is not responsible for failures, delays, inaccuracies, or service interruptions caused by third-party providers.
11. INTELLECTUAL PROPERTY RIGHTS
All content on the App and Website—logos, software, design, text, graphics, UI, and data—is owned by or licensed to Remitrip. Users may not copy, reproduce, modify, distribute, or create derivative works without written permission.
12. LIMITATION OF LIABILITY
To the maximum extent permitted by law, Remitrip is not liable for booking failures, schedule changes, fare variations, technical issues, payment gateway problems, delays or inaccuracies from IRCTC data, or indirect, incidental, punitive, or consequential damages. Your sole remedy for dissatisfaction is to discontinue using the Services.
13. INDEMNITY
You agree to indemnify, defend, and hold harmless Remitrip, its directors, officers, employees, and partners from any claims, liabilities, damages, losses, or expenses arising out of misuse of the Services, violation of these Terms, breach of IRCTC rules, or fraud.
14. TERMINATION
Remitrip may suspend or terminate access without prior notice if Terms are violated, fraudulent activity is detected, or if required by IRCTC or law enforcement. You may stop using the App at any time. Previous actions remain binding.
15. FORCE MAJEURE
Remitrip is not liable for failure to perform obligations due to events beyond its control, including natural disasters, system failures, network outages, government actions, strikes, epidemics, or disruptions in IRCTC systems.
16. GOVERNING LAW AND JURISDICTION
These Terms are governed by the laws of India. Courts located in Kochi, Kerala shall have exclusive jurisdiction over all disputes arising from these Terms.
17. CHANGES TO TERMS
Remitrip may modify these Terms at any time. Users will be notified through in-app notifications or updates on the Website. Continued use constitutes acceptance.
